A Summary of Act No. 17An Act to establish the Police Complaints Authority and for matters incidental thereto, assented to on July 13, 1993 and proclaimed on October 16, 1995. The Act established the Police Complaints Authority for the purpose of providing an independent and impartial civilian body (outside of the Police Service) to receive complaints on the conduct of any police officer, monitor the investigation of complaints, review reports and make decisions on all complaints. The Police Complaints Authority Act established another body to assist with addressing complaints made by members of the public. That body is the Complaints Division of the Police Service. The Complaints Division is mandated to investigate and resolve complaints thoroughly and impartially. Therefore, at the end of each month it is responsible for submitting to the Police Commissioner and the Authority progress reports on investigations and at the end of all investigations, a final report. In order to discharge its functions, the Authority has power to monitor the investigations and give guidance to the Division. It can also request information, documents or things relevant to the investigation/review of the compliant. At the review stage, the Authority has the power to request the parties to a complaint and witnesses to appear before it. Anyone who refuses to appear before the Authority, or obstructs, hinders, fails to comply with or in any way willfully misleads the Authority or anyone operating under the Act is guilty of an offence and liable on summary conviction to a fine of one thousand dollars ($1000) and to imprisonment for two (2) years.
