Act No. 22 of 1995 - A Summary
An Act to amend the Firearms Act, Chap 16:01 The Firearms (Amendment)
Act, 22 of 1995
This Act inter alia establishes the Firearms Appeal Board. The Board's
purpose is to hear and determine appeals from the decision of the Commissioner
of Police under sections 17 &21 of the Firearms Act, Chap. 16:01(section
7 of Act 22 of 1995).
A person aggrieved (dissatisfied) by the decision of the Commissioner
of Police not to grant him/her a firearm licence, certificate or permit,
or to revoke (cancel) it, may appeal to the Firearms Appeal Board to review
the decision.
Section 7 In the deliberation of an appeal, the board shall either: -
- dismiss the appeal: or
- allow the appeal and direct the Commissioner of Police
with or without conditions to grant or reinstate the licence, permit
or certificate.
The Board shall consist of the Chairman of the Police Complaints Authority
and two other members to be appointed by the President for a period of
three (3) years and eligible for reappointment on such remuneration and
terms and conditions as the President shall determine.
The Board may regulate its own procedure and that of conducting appeals.
It shall hear applications in camera (privately) and may permit: -
- an applicant or his representative;
- the Commissioner and his representative, to appear before the Board.
The majority of the members determine the decision of the Board.
The Board with the approval of the Prime Minister may by regulations
or otherwise confer powers and impose duties on any public officer or
any authority of the Government of Trinidad and Tobago for the purpose
of the exercise of its functions.
